The positions in brief:
De Bovib is positive about the legal presumption of employee status under an hourly rate of €32.24.
In the proposal there is insufficient balance between employee status and entrepreneurship. If only for reasons of feasibility and enforceability, it should first be assessed whether someone is clearly an entrepreneur. If that is the case, you do not proceed to the other criteria and no enforcement capacity is therefore wasted on them.
The impact of the bill on the availability of labor is seriously underestimated. The chance of unwanted outflow from certain occupations and sectors, caused by the uncertainty that has greatly increased because of this bill, is very real.
The affordability and the financial sustainability of the social security system can only be guaranteed by making it compulsory to open it up to all workers. This system is after all based is on solidarity and the spreading of risks.
The Bovib foresees major problems for hirers, including the Belastingdienst, Rijkswaterstaat and the CJIB. They will once again face unclear legislation and greater administrative burdens and risks. If the bill is implemented as it stands, we expect a repeat of the panic reaction in the market after the introduction of the DBA Act. That ultimately led to the current enforcement moratorium.
