How can I submit an invoice?

Clearly state on your invoice:

Ultra-fast payment and deduct 3% from the total amount excluding VAT. Then send the invoice to: versneldbetalen@circle8.nl and we do the rest.

We will pay your invoice, guaranteed, within 3 working days.

For a  accelerated payment  we will charge costs.

I want to use Premium payment within 8 working days. What should I do?

Mention ‘Accelerated payment’ on your invoice and deduct 2% from the total amount, excl. VAT. Then send the invoice to: versneldbetalen@circle8.nl en we do the rest. We guarantee to pay your invoice within 8 working days.

For a accelerated payment we charge fees.

What requirements must a correct invoice meet?

For preparing an invoice, invoice requirements have been formulated by the tax authorities. See the example on the website of the tax authorities.

What happens if the invoice is not correct?

If an invoice is not correct we will contact you. An incorrect invoice leads to a payment delay.

I have submitted an incorrect invoice. What should I do?

In that case we would like to receive a credit note or a debit note. This cancels the incorrect invoice in the accounting records. Simply sending a new invoice with the correct amount is not sufficient, even for your own bookkeeping.

DBA Act

Does the WDBA also apply to me?

If you work as a self-employed person or hire self-employed persons, the Act on Deregulation of the Assessment of Employment Relationships (WDBA) also applies to you. For the Tax and Customs Administration it must be clear whether there is an employment relationship; the WDBA should provide more clarity about that. It has not been possible to apply for a new VAR since 1 mei 2016 and it has not been possible to work with a VAR since 1 mei 2017.

Is it mandatory to work with a model agreement?

No, when it is obvious that a self-employed person is an entrepreneur and therefore it is clearly not a case of an employment relationship, it is not necessary to work with a model agreement. In case of doubt it is advisable for the contractor and the client to determine according to which model agreement they will work. In this way it is clear within which frameworks the work must be carried out in order not to be assessed as an employment relationship.

I hire ZP-ers via Circle8, what changes for me?

Circle8 will make use of model contracts and in other ways help clients mitigate the risks that arise with the WDBA. That also means that we ask for your permission for an accurate assignment description. How can I, as a client who hires self-employed people, minimize the risks?

As a client you can your complete indemnify against the hirer's and chain liability . You do this by hiring through an intermediary that is NEN 4400-1/2 certified and by using the disculpation arrangement whereby you deposit 25% of the total invoice amount into a G-account. Has the DBA Act been definitively implemented?

Yes, on 2 februari 2016 the Senate adopted the bill for the Deregulation of the Assessment of Employment Relationships Act (WDBA). On 1 mei 2016 this law came into force and a transition period applies until 1 januari 2018. Politicians are now busy clarifying the WDBA, e.g. the definitions of 'authority relationship' and 'free substitution', to remove ambiguity and uncertainty in the market for hirers and self‑employed persons.

What does the Dutch Tax and Customs Administration look at when assessing the employment relationship?

The Tax Administration has a ‘Guideline for the assessment framework of employment relationship agreements (DBA Guideline)’ issued. The most important checks are on the following characteristics:

1. Is there a relationship of authority towards the client and

2. Is there a personal obligation to perform work (aspect of free substitution)

Whistleblower scheme

Integrity is a core value for Circle8. We consider it important that suspicions of abuse or irregularities can be reported.

Unlike a complaint about the process, the whistleblower scheme is intended for reporting wrongdoing that is of public interest.
